Scope and Contents

Plaintiffs: Katharine and Mary Underwood (daughters of Thomas Underwood); Mary Wellum (daughter of John Wellum); Sarah and Mary English (daughters of John English, decd; represented by Edward Key)--all nieces of William Wellum. Defendants: William Barber the elder, guardian of William Barber, nephew of William Wellum.

Timeline of events: July 14, 1723: William Wellum, barber, of Melford , Suffolk, made a complicated will leaving a life interest to his wife Elizabeth, and then the estate to his nephew William Barber (an infant) with various legacies to his other nieces and nephews contingent on deaths, coming-of-age, etc.

June 19, 1723: William Wellum died.

October 3, 1723: Elizabeth Wellum his wife died.

June-July 1725: Trinity term: Plaintiffs brought Bill of Complaint in Chancery against William Barber, charging that he had withheld their legacies. Defendant said that it appeared to him that he should not pay before he came of age; asked Court's opinion; Court agreed with him.

June 28, 1728: Cause heard before the Lord Chancellor who ordered that the £30 legacies be paid with interest from October 3, 1723; that the £10 legacies wait until William Barber came of age; that the complainants pay the costs.
