General
Docketed: "Order about Bridges." Master of the Rolls. Inter John Cope and Gratiani ___ relict Jonathon Bridger; and T. Beringer and Arthur Moore, Arthur and John Midgeley gen p' Bill Revivor. The scope of the plaintiffs bill appeared to be that Thomas Berenger seized in Hereford lands in right of his wife agreed 13 May 1686 that she should have the disposal of them; but he first mortgaged them to Mr Reeves; wife left them to Grace 6 April 1695 and died; Thomas Berenger got an Act of Parliament to vest his other estate in the hands of Sir John Cutler (deceased) and Moore and Midgeley to sell the same to pay off Thomas Berenger's mortgage and debts. They have sold everything except the wife's lands and 12 acres in Iver, have paid the debts but not the mortgage on plaintiff's estate. Plaintiff wants the Iver acres sold; Defendant says the 12 acres are contracted by Hon Henry Pagett who has not yet paid, and defendant is willing that Pagett pay purchase, rents, and profitt to Grace; M[idgeley?] and M[idgeley?] say they are only trustees willing to do as Court directs. Court orders the Defendants to join in the sale to Pagett, and the said money be paid to Grace to satisfy the mortgage, and the trustees be indemnified
